3. Course contents *

This course focuses on logistic contracts in an international context. The topic is taught in from a contract-chain perspective, linked to the underlying and linked commercial transactions (in particular sales and insurance contracts). 

This course will start with an overview of the different logistic service providers and the impact of the chosen logistic service provider on the liability position of the cargo interested party. Here the focus will mainly lie with the distinction between carrier and transport intermediary. In the absence of international transport intermediary legislation, the solutions under Belgian, Dutch, French, German and English law will be discussed.

In the next section the course will  go deeper into carriage contracts under international transport law. Here the course will discuss the following topics: 

  1. Relation between sales contract and carriage contract
  2. Scope of application of international transport law
  3. Carrier liability and exoneration grounds
  4. Compensation 
  5. Procedural aspects
  6. Shipper liability
