The conditions for legitimate goal-based regulation
This policy brief examines the possibilities and limitations of goal-based regulation as a regulatory instrument in the context of technological and societal changes. It is argued that goal-based regulation rarely occurs in its pure form and is not inherently preferable to means-based regulation; hybrid models are often more suitable. Using a structured decision-making instrument, this policy brief outlines the conditions under which goal-based regulation is feasible and desirable. Furthermore, it is emphasised that successful implementation requires significant efforts from all involved actors, including regulators, supervised parties, interest groups, and enforcement agencies. Ultimately, goal-based regulation functions best within a culture of trust and cooperation, and it also has the potential to foster such a culture over time.
